Nothing in these terms excludes or limits liability that applicable law does not permit to be excluded or limited. In every jurisdiction, each disclaimer and limitation applies to the greatest extent permitted by applicable law.
Indemnity
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless the Publisher Parties from third-party claims, liabilities, damages, judgments, awards, losses, costs, expenses, and reasonable attorneys' fees arising from your unlawful or unauthorized use of the site, your breach of these terms, content or information you submit, your infringement of another person's rights, or your dealings with a third party reached through the site. This obligation does not require indemnification for conduct that cannot lawfully be indemnified.
We may control the defense and settlement of an indemnified claim with counsel of our choice. You agree to provide reasonable cooperation and may not settle a claim in a way that imposes liability, an admission, or a nonmonetary obligation on a Publisher Party without our prior written consent.
General Terms, Governing Law, and Contact
If a provision of these terms is held unenforceable, the remaining provisions remain in effect. A failure to enforce a provision once is not a waiver of the right to enforce it later. These terms, together with ourPrivacy Policy, Consumer Health Data Privacy Policy, and Affiliate Disclosure, state the terms governing this publication.
These terms are governed by the laws of the State of Washington, without regard to conflict-of-law rules. Subject to any nonwaivable consumer right, state and federal courts located in Clark County, Washington will have exclusive jurisdiction over a dispute arising from these terms or the site, and you consent to their personal jurisdiction and venue.
